TERMS AND CONDITIONS

IMPORTANT – PLEASE READ

It is the customer’s responsibility to ensure that all products ordered from Tanks-UK Ltd are the correct dimensions, weights, specifications and brands that are required. It is also the customers responsibility to ensure that the products ordered are fit for the purposes for which they are required. Tanks-UK Ltd cannot accept responsibility for any errors made during the ordering process, which are made as a result of the customer entering incorrect details. In such instances and where a product return is required, the return will incur collection and transportation fees payable by the customer.

Website users: By using our site, you confirm that you accept these terms and conditions and that you agree to comply with them. If you do not agree to these terms, you must not use our site.

These terms and conditions may be amended or updated at any time. We recommend that you check the terms and conditions before placing any order.

1. DELIVERY
Standard delivery costs for each product are as stated on our website or as quoted in writing. The delivery address must have access space and turning space for a 44-foot (13.4m) articulated lorry. The customer must have offloading facilities / equipment such as a forklift ready on delivery, to offload all products ordered. For orders where priority delivery time frames are required, or where access for an articulated lorry is not possible, please contact us to make alternative delivery arrangements.

Tail lift or pallet delivery coverage for orders weighing up to 500kg are available on request. Shipments exceeding 500kg weight or 1.2m length, width or height must be offloaded by forklift or other suitable lifting equipment. Where suitable offloading equipment is not available, delivery can be provided by one of our modified delivery trucks. A surcharge will apply to each delivery in such instances. Please request a quotation for delivery where offloading is required. It is the customers responsibility to conduct relevant health and safety risk assessments prior to delivery and offloading.

Unloading by any other method than those listed is at the customer’s own risk. Tanks-UK Ltd reserve the right to refuse delivery where suitable offloading equipment is not available.

Standard delivery charges apply to orders being delivered to most postcode areas within England, Wales and Scotland. Please contact us for a quote to deliver to the Channel Islands, Scottish Islands, Northern Ireland or Republic of Ireland.

Note that carriage terms are specific to individual brands, and inner city and remote destinations may incur surcharges. Please call us to check.

Delivery times, standard delivery for stocked products is 5-7 working days, from the date of order and provided that the order has been received before midday on the order date. Pallet delivery is 2 working days from despatch. Priority delivery is 48 hours. Please contact us for a quote on priority or pallet deliveries. Steel tanks require extended lead times. Please enquire at time of ordering. Made to order tanks will have delivery times which Tanks-UK Ltd will provide on a case-by-case basis.

Delivery dates are approximate only, and the exact time of delivery cannot be specified. Tanks-UK Ltd shall not be liable for any delay in delivery of the goods that is caused by a force majeure event, third party failure, or the customers failure to provide Tanks-UK Ltd with adequate delivery instructions or any other instructions that are relevant to the supply of the goods. Tanks-UK Ltd will inform the customer if it becomes aware of an unexpected delay. Please allow extra time for deliveries to the Scottish Highlands and Islands, the Channel Islands and Northern Ireland.

If the delivery driver is unable to offload the delivery for any reason, Tanks-UK Ltd reserve the right to charge for re-delivery on another date. It is the customer’s responsibility to ensure, prior to delivery, that safe offloading facilities are available.

Appropriate access for Tanks-UK Ltd delivery vehicles is compulsory on all orders. The customer will need to consider narrow lanes or low bridges that could limit our ability to deliver to the shipping address provided, in order to avoid delivery or return surcharges.
A signature and/or photographic evidence is required for all Tanks-UK Ltd deliveries.

Delivery to both EU and Non-EU territories will incur VAT charges, unless relevant exemption documentation is provided.

For deliveries to Northern Ireland, an EORI and VAT number will be required for the shipment documentation.

EU and Non-EU orders may be subject to relevant duties and taxes within the shipment address territory. All Tanks-UK Ltd orders are shipped Delivery Duty Unpaid. The customer is liable for any such duties imposed on Tanks-UK Ltd orders.

If Tanks-UK Ltd fails to deliver the goods ordered, we reserve the right to refund in full without liability. Tanks-UK Ltd shall have no liability for any failure to deliver the goods to the extent that such failure is caused by a force majeure event or the customer’s failure to provide us with adequate delivery instructions or any other instructions that are relevant to the supply of the goods.

2. CREDIT TERMS
Tanks-UK Ltd will not provide credit terms unless otherwise agreed with the customer in writing.
Payment for all orders will be required prior to the goods being shipped, unless credit terms have been agreed. Payment must be processed prior to the goods being shipped. Tanks-UK Ltd accepts payments made via Credit/Debit cards, Paypal, BACS, Cheque. Tanks-UK Ltd uses WorldPay to process debit and credit card transactions via its website. Card details are entered on a secure page and are transferred using SSL technology.

3. WARRANTIES
Warranties provided are always those of the manufacturer of the goods. Tanks-UK Ltd cannot accept liability for product warranties on behalf of the manufacturer under any circumstances, including instances where the manufacturer ceases trading.

Tanks-UK Ltd shall not be liable for incidental or consequential loss, damage or expenses, including but not limited to lost profits or other economic or commercial losses.

4. CANCELLATION

It is the customer’s responsibility to check the order acknowledgement to ensure that the goods ordered are correct for their requirements and in accord with their purchase order.

Once an order has been acknowledged, a cancellation charge of 10% of the value of the goods will apply if the customer cancels the order, unless otherwise agreed in writing.

5. RETURNS / DAMAGED GOODS
Returns being made as a result of damaged goods being received must be highlighted and reported to Tanks-UK Ltd, and the delivery carrier where a third-party delivery service has been used, within 7 days of delivery. Missing items must also be reported within 7 days. All claims must be made in writing and additional evidence such as photographs may be required.

Returns must be formally booked with Tanks-UK Ltd Ltd before being sent and a returns number must be obtained by the customer from Tanks-UK Ltd Ltd in such instances. Returns can be requested by contacting Tanks-UK Ltd at info@tanks-uk.com.

Returns made as a result of defective or damaged items being supplied by Tanks-UK Ltd will be processed at the expense of Tanks-UK Ltd. We cannot accept responsibility for any extra charges other than delivery costs in such instances.

Returns made as a result of appropriate offloading equipment not being available, an appropriate signatory not being available, access for the delivery vehicle not being adequate, or an order error made on the part of the customer, will be processed at the customer’s expense and will incur a minimum charge of £100.00. Orders returned due to a change of requirements on the customer’s part will also incur a minimum charge of £100.00.

Refunds will be processed within 28 days and will only be processed once the goods have been received and checked by Tanks-UK Ltd.  Tanks-UK Ltd reserve the right to charge restocking fees of 25% of the stated price on all standard products which have been correctly delivered and are not faulty.

Once goods have been used, they are then deemed as “Non-resalable” and Tanks-UK are not responsible to issue a return and refund. This includes goods ordered in error by customer, customer incompetence, goods no longer required and incompatible goods specified by the customer.

Bespoke (made to order) products will not be refunded unless received by the customer damaged or found to be faulty within 6 months of purchase.

Tanks-UK Ltd may offer to repair rather than replace tanks which have developed a fault within 6 months of purchase if this is reasonable under the circumstances.

All returns must be made within 28 days of purchase, except where manufacturing faults become apparent after 28 days but within 6 months of purchase. Except in circumstances where damaged or defective goods are being returned, all goods must be received back in the condition in which they were delivered, in order for refund claims to be accepted and processed by Tanks-UK Ltd.  Delivery and Service charges are Non-refundable.

6. TERMS OF WEBSITE USE

The customer is responsible for maintaining the confidentiality of account and password information and for restricting access to computers to prevent unauthorised account access. The customer agrees to accept responsibility for all activities that occur under their account or password.

Details and prices of products displayed on the website are given in good faith, but Tanks-UK Ltd retain the right to change the prices and specification of products where necessary without prior notice. Any customers placing orders for products which have changed for any reason will be notified as soon as the order is received.

Note that illustrations on the website are given for guidance only and goods delivered may differ in appearance from the website images. Specification sheets are available on request.

You may print off information from our website for your personal use and you may draw the attention of others within your organisation to content posted on our site.

Any information originating from our website used by you or your organisation must indicate the source and cite this in any communications.

7. Governing law and jurisdiction:
These terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, English law, and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
